Airworthiness Directives; McDonnell Douglas Model DC-9-30, DC-9-40, and DC-9- 50 Series Airplanes,

SUMMARY: We propose to adopt a new airworthiness directive (AD) for the McDonnell Douglas airplanes listed above. This proposed AD would require modifying the fuel boost pumps for the center wing, and forward or aft auxiliary fuel tanks. This proposed AD results from fuel system reviews conducted by the manufacturer. We are proposing this AD to prevent possible sources of ignition in a fuel tank caused by an electrical fault or uncommanded dry operation of the fuel boost pumps. An ignition source in the fuel tank could result in a fire or an explosion and consequent loss of the airplane.

Discussion

The FAA has examined the underlying safety issues involved in fuel tank explosions on several large transport airplanes, including the adequacy of existing regulations, the service history of airplanes subject to those regulations, and existing maintenance practices for fuel tank systems. As a result of those findings, we issued a regulation titled "Transport Airplane Fuel Tank System Design

Review, Flammability Reduction and Maintenance and Inspection Requirements" (66 FR 23086, May 7, 2001). In addition to new airworthiness standards for transport airplanes and new maintenance requirements, this rule included Special Federal Aviation Regulation No. 88 ("SFAR 88," Amendment 21-78, and subsequent Amendments 21-82 and 21-83).

Among other actions, SFAR 88 requires certain type design (i.e., type certificate (TC) and supplemental type certificate (STC)) holders to substantiate that their fuel tank systems can prevent ignition sources in the fuel tanks. This requirement applies to type design holders for large turbine- powered transport airplanes and for subsequent modifications to those airplanes. It requires them to perform design reviews and to develop design changes and maintenance procedures if their designs do not meet the new fuel tank safety standards. As explained in the preamble to the rule, we intended to adopt airworthiness directives to mandate any changes found necessary to address unsafe conditions identified as a result of these reviews.

In evaluating these design reviews, we have established four criteria intended to define the unsafe conditions associated with fuel tank systems that require corrective actions. The percentage of operating time during which fuel tanks are exposed to flammable conditions is one of these criteria. The other three criteria address the failure types under evaluation: Single failures, single failures in combination with a latent condition(s), and in- service failure experience. For all four criteria, the evaluations included consideration of previous actions taken that may mitigate the need for further action.

We have determined that the actions identified in this AD are necessary to reduce the potential of ignition sources inside fuel tanks, which, in combination with flammable fuel vapors, could result in fuel tank explosions and consequent loss of the airplane.

Boeing has determined a need to protect the fuel boost pump stator lead wires from contacting the pump rotor/shaft assembly. Lead wire contact and the resulting chafing may result in an ignition source (energized rotor assembly) being produced in the fuel boost pump inlet that could propagate into the fuel tank when the fuel boost pump inlet is not fully covered by fuel. Replacement of the fuel boost pumps will minimize the risk of potential ignition sources that may occur within the fuel tanks at critical fuel boost pump locations in the center wing, and forward or aft auxiliary fuel tanks. An ignition source in the fuel tank could result in a fire or an explosion and consequent loss of the airplane.

Relevant Service Information

We have reviewed Boeing Service Bulletins DC9-28-212 (for Model DC-9-30, DC-9-40, and DC-9-50 series airplanes, and Model DC-9-81 (MD-81), DC-9-82 (MD- 82), DC-9-83 (MD-83), DC-9-87 (MD-87), and MD-88 airplanes) and MD90-28-010, (for MD-90-30 airplanes), both dated February 22, 2008. The service bulletins describe procedures for modifying the fuel boost pumps for the center wing, and forward or aft auxiliary fuel tanks. The modification includes changing or replacing the boost pumps, as applicable. The change includes incorporating a stator lead wire position retention feature.

The Boeing service bulletins recommend concurrent accomplishment of the modification in Argo-Tech Service Bulletin 398000-28-2, dated November 8, 2007. The Argo-Tech Service Bulletin describes procedures for modifying the fuel boost pumps.

FAA's Determination and Requirements of This Proposed AD

We are proposing this AD because we evaluated all relevant information and determined the unsafe condition described previously is likely to exist or develop in other products of these same type designs. This proposed AD would require accomplishing the actions specified in the Boeing service information described previously.

Costs of Compliance

We estimate that this proposed AD would affect 804 airplanes of U.S. registry. The following table provides the estimated costs for U.S. operators to comply with the modification specified in this proposed AD. The fleet cost is estimated to be between $1,246,200 and $13,087,512.

Authority for This Rulemaking

Title 49 of the United States Code specifies the FAA's authority to issue rules on aviation safety. Subtitle I, section 106, describes the authority of the FAA Administrator. "Subtitle VII: Aviation Programs," describes in more detail the scope of the Agency's authority.

We are issuing this rulemaking under the authority described in "Subtitle VII, Part A, Subpart III, Section 44701: General requirements." Under that section, Congress charges the FAA with promoting safe flight of civil aircraft in air commerce by prescribing regulations for practices, methods, and procedures the Administrator finds necessary for safety in air commerce. This regulation is within the scope of that authority because it addresses an unsafe condition that is likely to exist or develop on products identified in this rulemaking action.

Regulatory Findings

We determined that this proposed AD would not have federalism implications under Executive Order 13132. This proposed AD would not have a substantial direct effect on the States, on the relationship between the national Government and the States, or on the distribution of power and responsibilities among the various levels of government.

For the reasons discussed above, I certify this proposed regulation:

1. Is not a "significant regulatory action" under Executive Order 12866,

2. Is not a "significant rule" under the DOT Regulatory Policies and Procedures (44 FR 11034, February 26, 1979), and

3. Will not have a significant economic impact, positive or negative, on a substantial number of small entities under the criteria of the Regulatory Flexibility Act.

Unsafe Condition

(d) This AD results from fuel system reviews conducted by the manufacturer. We are issuing this AD to prevent possible sources of ignition in a fuel tank caused by electrical fault or uncommanded dry operation of the fuel boost pumps. An ignition source in the fuel tank could result in a fire or an explosion and consequent loss of the airplane.

Compliance

(e) Comply with this AD within the compliance times specified, unless already done.

Modification

(f) Within 60 months after the effective date of this AD: Modify the fuel boost pumps for the center wing, and forward or aft auxiliary fuel tanks, as applicable, by doing all the applicable actions specified in the Accomplishment Instructions of Boeing Service Bulletin DC9-28-212 or MD90-28- 010, both dated February 22, 2008, as applicable.

Prior or Concurrent Action

(g) Prior to or concurrently with accomplishing the modification required by paragraph (f) of this AD: Do the modification specified in Argo-Tech Service Bulletin 398000-28-2, dated November 8, 2007.

Alternative Methods of Compliance (AMOCs)

Writethru: Uganda's ADF rebels seek peace talks with government - Zibb.com

Uganda's rebel group the Allied Democratic Forces (ADF) has asked for peace talks with the government to end its 12-year-long insurgency, a government official has said.

The State Minister for Internal Affairs Matia Kasaija was quoted by the state-owned New Vision daily on Tuesday as saying that the rebels, through the Amnesty Commission, had sent a memorandum to the government indicating its willingness to peace talks with the government.

"The government has agreed to the peace talks but the date and venue is yet to be decided," Kasaija told the legislators on the defense and internal affairs committee on Monday.

He revealed that the government had set aside a provisional fund of 2 billion Ugandan shillings (about 1.25 million U.S. dollars) to facilitate the talks.

"We don't want to experience a situation similar to the one we faced when the Juba peace talks commenced. The talks began without funds," Kasaija said.

The Ugandan government started fresh negotiations with the country's most notorious rebel group, Lord's Resistance Army (LRA) in July 2006 in Juba, southern Sudan under the auspice of southern Sudanese authority.

Kasaija further responded to some doubts from the legislators that ADF is not longer a threat, saying the latest information indicated that the ADF was reorganizing in the neighboring Democratic Republic of Congo (DR Congo) and could attack the country anytime.

Justice Peter Onega, the chairman of the Amnesty Commission, said he had discussed the matter with ADF top commanders.

Onega said he met Jamil Mukulu, the rebel leader, Yusuf Kabanda, his deputy and ten other top commanders, who all indicated that they were ready for peace talks.

"I twice met Mukulu, Kabanda and ten other top commanders based in Congo (DR Congo). They assured me that they wanted to talk peace and come back home. They are tired of fighting. I am sure within a few months, we shall be able to proceed," Onega said.

Mukulu, a Catholic turned Muslim, heads the force which initially recruited Muslim youth, who cited marginalization. Together with the defunct National Army for the Liberation of Uganda, they moved to western Uganda in 1996 where they started a rebellion.

They set up bases in DR Congo where they recruited and trained fighters with the promise of money and education.

Currently, the peace negotiations between the Ugandan government and the LRA have concluded.

FDLR Rebels Cutting Down Virunga Forests for Charcoal - Zibb.com

As conservationists in the Virunga park struggle to protect the forests that is home to the much prized Gorillas, Rwandan rebels in DR Congo - FDLR - also want the charcoal from cutting down the trees, as a recent encounter revealed.

Conservationists with organizations such as the Wildlife Direct report that the park's dense forest is rapidly being depleted of its trees to satisfy the almost insatiable demand for charcoal. The substance is used for cooking and heating by the millions of people living in this troubled region.

On June 27, a team of Rangers left the Kibumba post to patrol for charcoal makers in the Kanyamahoro area of the DR Congo side of the park that is shared with Rwanda and Uganda. They soon came across two women in the forest who were carrying bags of charcoal. The women dropped the bags and escaped into the forest, according to the rangers.

The Rangers took the charcoal and continued on their patrol. What they didn't know, as they narrate, was that the women had ran to a village to tell the local the Democratic Forces for the Liberation of Rwanda (FDLR) rebels - that the Rangers were there.

Apparently, soon the FDLR rebels found the Rangers and a confrontation ensued in which 3 Rangers were captured, 4 were able to escape. Another went missing.

The rebel group - some whose members are wanted in Rwanda for Genocide crimes - is subject to a regional plan in which they are required to surrender to Rwanda peacefully or to be forced.

"It was at that point that I got a call from one of the captured Rangers, informing me of the situation. The rebels were unhappy that the charcoal had been confiscated and wanted it back in exchange for the Rangers", explains Innocent - head of the Rangers.

"I spoke to the rebel chief on the phone and told him that we could not give the illegal charcoal back. After much negotiation, the Rangers were finally released that evening and they went to the nearest UN base for safety".

Innocent however says at that point there was still one Ranger missing - Albert Sebagabo.

He narrates: "The rebels assured me that they didn't know where he was. We waited and waited into the night, but still no sign of Albert. The next morning at 9 AM, Albert finally arrived at the Kibati patrol post. He had spent the night on his own in the forest after having escaped the rebels. He was a bit shaken and tired, but OK."

The lucrative charcoal trade is not only wreaking havoc on the park but also on its most famous inhabitants, the rare mountain gorillas, says WildLife Direct- a conservation group based in the Democratic Republic of Congo and Kenya that supports the park rangers working in Virunga.

Conservationists also believe that last year's execution of about seven gorillas inside the park was carried out by people associated with the charcoal trade who want the park unprotected.

The National Geographic reports that in a steady trickle teenage boys push their way down a dusty road to the bustling city of Goma - capital of North Kivu province - their bicycles buckling under the weight of 100-pound (45-kilogram) sacks of charcoal, or makala as it's known there.

The boys are part of an illegal trade that may pose the biggest threat to one of the most pristine places on the planet, the Virunga National Park, as the research channel notes.

"The gorillas have become a hindrance for the charcoal trade," said Emmanuel de Merode, director of Wildlife Direct.

"There's a very strong incentive for these people to kill the gorillas."

Threats to the gorillas are not just coming from the Rwandan rebels. In September last year rebels loyal to DRC dissident General Laurent Nkunda occupied sections of the park rising fear among conservationists about the fate. WildLife Direct says the rebels looted weapons and communication equipment from Jomba and Bikenge ranger patrol posts within the park.

Meanwhile, a regional inter-ministerial conference is going on in north Western Rwanda border town of Rubavu - where delegates from the three countries are discussing a 10-year strategic conservation plan. The regional governments with their partners - the U.S and the European Union - have a $100 million fund that they hope will go a long way to protect the region's habitat that's been bringing in vast revenue from tourism.
