ArcelorMittal files suit against Esmark, E2 Acquisition
SAN FRANCISCO, May 09, 2008 (Thomson Financial via COMTEX) -- By Staff Reporter
ArcelorMittal late Thursday said it has filed a lawsuit against Esmark Inc. and its affiliate E2 Acquisition Corp. in the Supreme Court of the State of New York.
ArcelorMittal is seeking $540 million in connection with Esmark/E2's alleged breach of a 2007 contact to purchase the Sparrows Point steel manufacturing facility for $1.35 billion.
The Aug. 1, 2007, contract was terminated Dec. 16 after Esmark/E2 did not complete the deal, ArcelorMittal said.
OAO Severstal bought Sparrows Point for $810 million, net of debt, on May 7, 2008.
ArcelorMittal shares closed the regular session up $3.88 at $96.02. Esmark stock rose 4 cents to $16.85. Brigid Gaffikin bg/gm
