SEC Brings Action Against Attorney For Alleged Role in An Unregistered Offering Fraud

The Law Firm of Gregory Bartko, LLC announced today that the U.S. Securities and Exchange Commission ("SEC") notified the law firm that the SEC filed a civil enforcement action against one of the firm's clients, Daniel W. Nodurft, Esq., an attorney practicing in New Orleans, Louisiana. The lawsuit, SEC v. Daniel W. Nodurft, U.S. District Court--Middle District of Florida, Case No. 8:09-cv-866-T-26-TGW, filed on May 8, 2009 is a related case associated with another civil enforcement action previously filed in the same Court against Aerokinetic Energy Corporation and its President, Randy E. Bridwell, SEC v. Aerokinetic Energy Corporation and Randolph E. Bridwell, U.S. District Court--Middle District of Florida, Case No. 8:08-cv-1409-T-27-MSS, that has since been settled.

The complaint filed against Mr. Nodurft includes virtually the same allegations originally made by the SEC against Aerokinetic Energy Corporation and Mr. Bridwell. Mr. Bartko remarked that he "believed it to be legally inappropriate for the SEC to file a second lawsuit against Mr. Nodurft in his role as the corporate secretary of Aerokinetic Energy Corporation no sooner than the ink was dry on the settlement agreement reached in the first case brought by the SEC. It seems like 'piling on' to me," said Mr. Bartko.

Upon the filing of most all SEC civil enforcement or administrative actions that assert violations of Federal securities laws, the SEC publishes a press release at www.sec.gov disclosing the nature of the complaint and the parties being sued by the SEC. This policy of issuing press releases without also permitting those persons being sued by the SEC a fair and equal forum to address the alleged violations made in the SEC complaint and repeated in SEC press releases, has long been recognized as a means of damaging the reputation of the parties whom are targets of the SEC enforcement division without considerations of due process.
