ATT and Leading Child Safety Organizations Take Online Safety to the Classroom - Zibb.com
DALLAS, Aug 20, 2008 /PRNewswire-FirstCall via COMTEX/ --
AT&T Inc. (NYSE: T) today announced it is returning to the classroom through online safety education developed by the Internet Keep Safe Coalition (iKeepSafe) and presented by Drug Abuse Resistance Education (D.A.R.E.) officers. As the nation's largest broadband and wireless provider, AT&T has a longstanding commitment to protect consumers online and safeguard their Internet experience. The company offers parental controls for various communications modes such as Surf Smart (Internet at home), Wireless Smart (mobile phone), Watch Smart (TV) and Talk Smart (home phone).
Through the storybook adventures of iKeepSafe's Internet safety character, Faux Paw the Techno Cat(R), elementary students grades 1-5 will learn about online safety, with emphasis on cyber-bullying awareness for fifth graders. D.A.R.E. officers will visit classrooms and present animated movies and books to students, then engage in educational exercises. AT&T will later join D.A.R.E. officers at community forums, where local residents and parents can learn about online safety and how they can keep their families safe online.
"Ninety percent of tweens report they have used the Internet by the time they are nine years old," said Brent Olson, AT&T assistant vice president of Public Policy. "That's why it's important for online safety education efforts to reach elementary-school-aged children, before they become active online users."
"It's equally important for parents, families, and communities to understand the current challenges involved in keeping their children safe online, whether over the computer or over the cell phone -- which every parent of a texter knows is quickly becoming the primary mode of communication for today's tweens and teens," Olson added. "We are excited to join with iKeepSafe and D.A.R.E to bring these important messages to local schools and communities."
Approximately 4,500 D.A.R.E officers will be trained to present the program in hundreds of cities nationwide over the course of the 2008-2009 school year.
"This program uses positive messaging to teach children in an entertaining and effective way about online safety and about how to be good digital citizens," said Marsali Hancock, president of iKeepSafe. "Studies have shown that positive messaging resonates with children better than scare tactics. It's essential we deliver those messages when children are young and receptive -- before they become 'experts' at digital communication."
"D.A.R.E America is proud to join with iKeepSafe and AT&T to assist in the vital work of helping our young people avoid and combat cyber-bullying," said Anita Bryan, deputy director for education, D.A.R.E America. "This destructive and hurtful behavior is a direct obstacle to the learning and growth that children may experience from healthy use of the Internet."
Along with its participation in the iKeepSafe and D.A.R.E. program, AT&T is also an active member of the Family Online Safety Institute (FOSI) -- an international nonprofit organization committed to providing innovative solutions for family online safety -- which will issue three studies focused on best practices in online safety education.
AT&T is also supporting a program through Enough Is Enough, an Internet safety organization dedicated to protecting children and families from the Internet dangers of pornography and sexual predators. The Enough Is Enough program targets at-risk youth, who have little to no parental supervision and are in an environment that makes them more susceptible to risky online behavior. The pilot program launches in Virginia in the fall, and the national rollout is next year. The Enough Is Enough organization will also distribute an online safety 101 kit for parents later this year, with tips and instruction from a variety of organizations and companies, including AT&T.
AT&T offers a full library of supportive Internet safety and security tips and interactive safety games for kids, all available at http://www.att.com/safety. In addition, consumers can go to http://OnGuardOnline.gov to review practical tips from the federal government and the technology industry to help them be on guard against Internet fraud, secure their computer and protect their personal information.

I. Change of IBR Format
This format revision will affect the "Identification of plan" section of 40 CFR part 52, as well as the format of the SIP materials that will be available for public inspection at the National Archives and Records Administration (NARA); the Air and Radiation Docket and Information Center located at EPA Headquarters in Washington, DC, and the EPA New England Regional Office.
A. Description of a SIP
Each state has a SIP containing the control measures and strategies used to attain and maintain the national ambient air quality standards (NAAQS) and achieve certain other Clean Air Act (Act) requirements (e.g., visibility requirements and prevention of significant deterioration). The SIP is extensive, containing such elements as air pollution control regulations, emission inventories, monitoring network descriptions, attainment demonstrations, and enforcement mechanisms.
B. How EPA Enforces the SIP
Each SIP revision submitted by Maine must be adopted at the state level after undergoing reasonable notice and opportunity for public comment. SIPs submitted to EPA to attain or maintain the NAAQS must include enforceable emission limitations and other control measures, schedules and timetables for compliance.
EPA evaluates submitted SIPs to determine if they meet the Act's requirements. If a SIP meets the Act's requirements, EPA will approve the SIP. EPA's notice of approval is published in the Federal Register and the approval is then codified in the Code of Federal Regulations (CFR) at 40 CFR part 52. Once EPA approves a SIP, it is enforceable by EPA and citizens in Federal district court.
We do not reproduce in 40 CFR part 52 the full text of the Maine regulations that we have approved; instead, we incorporate them by reference ("IBR"). We approve a given state regulation with a specific effective date and then refer the public to the location(s) of the full text version of the state regulation(s) should they want to know which measures are contained in a given SIP (see "I.F. Where You Can Find a Copy of the SIP Compilation").
C. How the State and EPA Update the SIP
The SIP is a living document which the state can revise as necessary to address the unique air pollution problems in the state. Therefore, EPA from time to time must take action on SIP revisions containing new and/or revised regulations.
On May 22, 1997 (62 FR 27968), EPA announced revised procedures for incorporating by reference federally approved SIPs. The procedures announced included: (1) A new process for incorporating by reference material submitted by states into compilations and a process for updating those compilations on roughly an annual basis; (2) a revised mechanism for announcing EPA approval of revisions to an applicable SIP and updating both the compilations and the CFR; and (3) a revised format for the "Identification of plan" sections for each applicable subpart to reflect these revised IBR procedures.
D. How EPA Compiles the SIP
We have organized into a compilation the federally-approved regulations, source-specific requirements and nonregulatory provisions we have approved into the SIP. We maintain hard copies of the compilation in binders and we primarily update these binders on an annual basis.
E. How EPA Organizes the SIP Compilation
Each compilation contains three parts. Part one contains the state regulations, part two contains the source-specific requirements that have been approved as part of the SIP (if any), and part three contains nonregulatory provisions that we have approved. Each compilation contains a table of identifying information for each regulation, each source-specific requirement, and each nonregulatory provision. The state effective dates in the tables indicate the date of the most recent revision to a particular regulation. The table of identifying information in the compilation corresponds to the table of contents published in 40 CFR part 52 for the state. The EPA Regional Offices have the primary responsibility for ensuring accuracy and updating the compilations.
F. Where You Can Find a Copy of the SIP Compilation
EPA New England developed and will maintain a hard copy of the compilation for Maine. An electronic copy of the
[Page Number 56972]
Maine regulations we have approved are available on the following Web site: http://www.epa.gov/ne/topics/air/sips.html. A hard copy of the regulatory and source-specific portions of the compilation will also be maintained at the Air and Radiation Docket and Information Center, EPA West Building, Room 3334, 1301 Constitution Ave., NW., Washington, DC 20460; and National Archives and Records Administration (NARA). If you wish to obtain materials from a docket in the EPA Headquarters Library, please call the Office of Air and Radiation (OAR) Docket/Telephone number (202) 566-1742. For information on the availability of this material at NARA, call (202) 741-6030, or go to: http://www.archives.gov/federal_register/code_of_federal_regulations/ibr_locat ions.html.
G. The Format of the New Identification of Plan Section
In order to better serve the public, EPA has revised the organization of the "Identification of plan" section in 40 CFR part 52 and included additional information to clarify the elements of the SIP.
The revised Identification of plan section for Maine contains five subsections:
1. Purpose and scope (see 40 CFR 52.1020(a));
2. Incorporation by reference (see 40 CFR 52.1020(b));
3. EPA-approved regulations (see 40 CFR 52.1020(c));
4. EPA-approved source-specific requirements (see 40 CFR 52.1020(d)); and
5. EPA-approved nonregulatory provisions such as transportation control measures, statutory provisions, monitoring networks, etc. (see 40 CFR 52.1020(e)).
H. When a SIP Revision Becomes Federally Enforceable
All revisions to the applicable SIP are federally enforceable as of the effective date of EPA's approval of the respective revisions. In general, SIP revisions become effective 30 to 60 days after publication of EPA's SIP approval action in the Federal Register . In specific cases, a SIP revision action may become effective less than 30 days or greater than 60 days after the Federal Register publication date. In order to determine the effective date of EPA's approval for a specific Maine SIP provision that is listed in paragraph 40 CFR 52.1020 (c), (d), or (e), consult the volume and page of the Federal Register cited in the "EPA approval date" column of 40 CFR 52.1020 for that particular provision.
I. The Historical Record of SIP Revision Approvals
To facilitate enforcement of previously approved SIP provisions and to provide a smooth transition to the new SIP processing system, we are retaining the original Identification of plan section (see 40 CFR 52.1037). This section previously appeared at 40 CFR 52.1020. After an initial two-year period, we will review our experience with the new table format and will decide whether or not to retain the original Identification of plan section (40 CFR 52.1037) for some further period.
II. What EPA Is Doing in This Action
Today's action constitutes a "housekeeping" exercise to reformat the codification of the EPA-approved Maine SIP.
III. Good Cause Exemption
EPA has determined that today's action falls under the "good cause" exemption in section 553(b)(3)(B) of the Administrative Procedure Act (APA) which, upon a finding of "good cause," authorizes agencies to dispense with public participation, and section 553(d)(3), which allows an agency to make a rule effective immediately (thereby avoiding the 30-day delayed effective date otherwise provided for in the APA). Today's action simply reformats the codification of provisions which are already in effect as a matter of law.
Under section 553 of the APA, an agency may find good cause where procedures are "impractical, unnecessary, or contrary to the public interest." Public comment is "unnecessary" and "contrary to the public interest" since the codification only reflects existing law. Likewise, there is no purpose served by delaying the effective date of this action.
IV. Statutory and Executive Order Reviews
A. General Requirements
Under Executive Order 12866 (58 FR 51735, October 4, 1993), this action is not a "significant regulatory action" and is therefore not subject to review by the Office of Management and Budget. This rule is not subject to Executive Order 13211, "Actions Concerning Regulations That Significantly Affect Energy Supply, Distribution, or Use" (66 FR 28355, May 22, 2001) because it is not a significant regulatory action under Executive Order 12866. Because the agency has made a "good cause" finding that this action is not subject to notice-and- comment requirements under the Administrative Procedure Act or any other statute as indicated in the Supplementary Information section above, it is not subject to the regulatory flexibility provisions of the Regulatory Flexibility Act (5 U.S.C 601 et seq.), or to sections 202 and 205 of the Unfunded Mandates Reform Act of 1995 (UMRA) (Pub. L. 104-4). In addition, this action does not significantly or uniquely affect small governments or impose a significant intergovernmental mandate, as described in sections 203 and 204 of UMRA. This rule also does not have a substantial direct effect on one or more Indian tribes, on the relationship between the Federal Government and Indian tribes, or on the distribution of power and responsibilities between the Federal Government and Indian tribes, as specified by Executive Order 13175 (65 FR 67249, November 9, 2000), nor will it have substantial direct effects on the States, on the relationship between the national government and the States, or on the distribution of power and responsibilities among the various levels of government, as specified in Executive Order 13132 (64 FR 43255, August 10, 1999). This rule also is not subject to Executive Order 13045 (62 FR 19885, April 23, 1997), because it is not economically significant. This rule does not involve technical standards; thus the requirements of section 12(d) of the National Technology Transfer and Advancement Act of 1995 (15 U.S.C. 272 note) do not apply. The rule also does not involve special consideration of environmental justice related issues as required by Executive Order 12898 (59 FR 7629, February 16, 1994). In issuing this rule, EPA has taken the necessary steps to eliminate drafting errors and ambiguity, minimize potential litigation, and provide a clear legal standard for affected conduct, as required by section 3 of Executive Order 12988 (61 FR 4729, February 7, 1996). EPA has complied with Executive Order 12630 (53 FR 8859, March 15, 1998) by examining the takings implications of the rule in accordance with the "Attorney General's Supplemental Guidelines for the Evaluation of Risk and Avoidance of Unanticipated Takings" issued under the executive order. This rule does not impose an information collection burden under the Paperwork Reduction Act of 1995 (44 U.S.C. 3501 et seq.). EPA's compliance with these statutes and Executive Orders for the underlying rules is discussed in previous actions taken on the State's rules.
[Page Number 56973]
B. Submission to Congress and the Comptroller General
The Congressional Review Act (5 U.S.C. 801 et seq.), as added by the Small Business Regulatory Enforcement Fairness Act of 1996, generally provides that before a rule may take effect, the agency promulgating the rule must submit a rule report, which includes a copy of the rule, to each House of the Congress and to the Comptroller General of the United States. Section 808 allows the issuing agency to make a rule effective sooner than otherwise provided by the CRA if the agency makes a good cause finding that notice and public procedure is impracticable, unnecessary or contrary to the public interest. Today's action simply reformats the codification of provisions which are already in effect as a matter of law, 5 U.S.C. 808(2). As stated previously, EPA has made such a good cause finding, including the reasons therefore, and established an effective date of March 1, 2007. EPA will submit a report containing this rule and other required information to the U.S. Senate, the U.S. House of Representatives, and the Comptroller General of the United States prior to publication of the rule in the Federal Register . These corrections to the Identification of plan for Maine is not a "major rule" as defined by 5 U.S.C. 804(2).
C. Petitions for Judicial Review
EPA has also determined that the provisions of section 307(b)(1) of the Clean Air Act pertaining to petitions for judicial review are not applicable to this action. Prior EPA rulemaking actions for each individual component of the Maine SIP compilation had previously afforded interested parties the opportunity to file a petition for judicial review in the United States Court of Appeals for the appropriate circuit within 60 days of such rulemaking action. Thus, EPA sees no need to reopen the 60-day period for filing such petitions for judicial review for this reorganization of the "Identification of plan" section of 40 CFR 52.1020 for Maine.

Lehman Trikes presents 2008 Good Turn Trike - Zibb.com
CALGARY, Sep. 8, 2008 (Canada NewsWire via COMTEX) --
TSXV -- LHT
Lehman Trikes is proud to announce that the 2008 Good Turn Trike was presented to Jon Brough at Niehaus Cycle in Litchfield, Illinois on August 23, 2008. Earlier in the summer, Jon was selected as the recipient of Lehman Trikes' 2008 Good Turn Trike. Jon had been a policeman in Belleville, IL for 22 years when he was shot in the face while he and a group of fellow officers were attempting to arrest a murder suspect. Jon has been recognized and honored for his work as a policeman by national, state, regional and local law enforcement organizations. He has also been lauded for his outstanding community service work with organizations such as D.A.R.E and little league baseball.
Jon and his wife Wendy were motorcyclists long before his injury and often enjoyed going on motorcycle rides with fellow members of the Blue Knights. After Jon's injury, Wendy discontinued her 25 year career as a nurse to take care of Jon. For over 22 years, the couple has enjoyed a loving and caring relationship, which is evident by their words and actions. Since his injury, Jon has maintained his tremendous sense of humor and even makes jokes about Wendy being in the driver's seat of their new trike.
After the presentation, Jon was whisked away on the back of his new Monarch II trike arms raised in the air, sun and wind in his face, aglow with joy and happiness. Jon loudly and excitedly exclaimed, "I'm really livin' again!" The trike kit was installed by Niehaus Cycle on a brand new 2008 Honda GL1800 Gold Wing, funds for which were raised by members of the Blue Knights International Law Enforcement Motorcycle Club, Illinois Chapter 14. Jon told a Lehman Trike representative and Blue Knights members at the presentation, "I can't thank everyone enough who has helped make this possible. I just hope that sometime down the line, I can help someone else like you have helped me."
Ken Hines, Executive Vice-President stated upon making the presentation, "It is a real pleasure to help get someone like Jon back on the road. Jon is a success on so many levels. He possesses remarkable self-worth, daily he exhibits tremendous courage, humility, and strength of character. He marches to the beat of his own happy drum. Jon invariably seems to give back more than he is given. It is indeed a pleasure to help someone of Jon's caliber who is so inspirational to others."

Johns Hopkins & American Academy of Nurse Practitioners Launch Award Program to Recognize Top
NEW YORK CITY, Sep 25, 2008 (BUSINESS WIRE) --
The Johns Hopkins University School of Medicine, Office of Continuing Medical Education (JHU) and the American Academy of Nurse Practitioners (AANP) announced today the launch of the Educational Initiative on Constipation (EIC) Award for Clinical Excellence (ACETM) program. This professional award recognizes physicians, physician groups, nurse practitioners and physician assistants who have demonstrated expanded knowledge, skills and attitudes, as well as improved care and positive results for patients with chronic constipation and irritable bowel syndrome (IBS) with constipation (IBS-C) due to their participation in the JHU and AANP EIC initiative.
"Through the ACETM program, Johns Hopkins Continuing Medical Education recognizes healthcare providers who deliver superior patient care and positive results as they integrate their learnings from the EIC program, allowing them to better identify and manage the large number of underdiagnosed and undertreated patients suffering from chronic constipation and IBS-C," states Mark Donowitz, M.D., Professor of Medicine and Physiology, the LeBoff Professor for Research in Digestive Diseases at the Johns Hopkins University School of Medicine, former President of the American Gastroenterology Association Institute, and the EIC Course Director. "These healthcare providers are examples to the profession and deserve to be acknowledged by colleagues, patients and the overall community for the quality care they provide to this underserved patient population."
To be eligible for the ACETM program, the applicant must be a physician, physician group, nurse practitioner or physician assistant who participates in the EIC program, completes the performance improvement (PI) component of the educational initiative and demonstrates optimized care and outcomes for patients with constipation or IBS-C. There is no fee to apply. Nine healthcare providers (three physicians, three nurse practitioners and three physician assistants) will be recognized by Johns Hopkins Continuing Medical Education (CME) and the AANP using an objective, accepted methodology to evaluate patient care with outcome-related metrics. Winners will receive an award certificate from Johns Hopkins CME and the AANP, a listing on the Johns Hopkins CME web site for one year, and national and local recognition for the healthcare provider's clinical expertise.
For more detailed information about eligibility and the application process, please visit the Johns Hopkins CME website at www.hopkinscme.edu/ofp/eic, call 201-984-3332 ext. 4, or email EICinfo@gullapalliandassoc.com.
"Not only does the ACETM program recognize clinicians who have successfully implemented best practices gained from the EIC, but it also encourages other healthcare providers to embrace evidence-based medicine to improve clinical outcomes for patients with chronic constipation or IBS-C within their own practice," said Julia Pallentino M.S.N., J.D., A.R.N.P. at GI Associates of Tallahassee. "The benefits of the EIC and the ACE programs are far-reaching for individuals suffering from these conditions, as well as for the public health of the nation."
ABOUT THE JOHNS HOPKINS UNIVERSITY SCHOOL OF MEDICINE
In July 2008, U.S. News & World Report ranked the Johns Hopkins Hospital #1 among American hospitals for the 18th consecutive year. In 2006, the Johns Hopkins Office of CME received "Accreditation with Commendation" for six years, the highest ranking issued by the ACCME. Hopkins CME has been recognized as a center for "Best Practices" and as a resource to ACCME-accredited providers. For more information, please visit www.hopkinscme.edu or contact Victor Marrow, Ph.D., Executive Director, Office of Funded Programs at vmarrow@jhmi.edu.
ABOUT THE AMERICAN ACADEMY OF NURSE PRACTITIONERS
With over 25,000 individual members and 154 group members, AANP represents the interests of over 125,000 nurse practitioners. AANP has steadily expanded its services and priorities to meet its mission to serve as a resource for nurse practitioners (NPs), their patients and other healthcare consumers; to promote excellence in practice, education and research; to provide legislative leadership; to advance health policy and establish healthcare standards; and to advocate for access to quality and cost effective healthcare by NPs. As the largest and only full-service national, professional membership organization for NPs of all specialties, AANP advocates at local, state, and federal levels for the recognition of NPs as providers of high-quality, cost-effective, and personalized healthcare. For more information, please visit www.aanp.org.
ABOUT THE EDUCATIONAL INITIATIVE ON CONSTIPATION
The EIC is a multidisciplinary, performance improvement (PI) CME/CE educational initiative designed to measurably improve the treatment of chronic constipation and IBS-C by gastroenterologists, primary care physicians, nurses, nurse practitioners, and physician assistants. The foundation for this program is a live symposium held at the American College of Gastroenterology 2008 Annual Scientific Meeting and Postgraduate Course in Orlando, Florida, on October 3-8, 2008.
The core curriculum will focus on improving the knowledge and behavior of healthcare providers in the areas of IBS-C and chronic constipation. The educational program will be presented to participants in various modules containing interventions ranging from a performance improvement component to webinars and video satellite broadcasts.
ABOUT CHRONIC CONSTIPATION AND IBS WITH CONSTIPATION (IBS-C)
Chronic constipation is a pervasive condition in the United States. Patients with chronic constipation often experience hard stools, straining during bowel movements and not enough bowel movements during the week. People with chronic constipation can experience serious discomfort which interferes with their ability to work and their quality of life. Up to 26 million Americans suffer from the condition and, of these, about five million are classified as "severe". Data from the National Disease and Therapeutic Index shows a relatively stable value of 2.5 million annual physician visits for constipation and more recent data that includes emergency room encounters estimates the number of physician visits for constipation-related complaints at 5.7 million in 2001. Using the conservative estimates of "prevalence, healthcare seeking, and costs," the annual direct costs attributable to chronic constipation in North America are in the billions of dollars.
Up to one-sixth of adults experience irritable bowel syndrome (IBS), a condition marked by disturbed bowel function and abdominal pain. IBS patients can have three different sets of symptoms: diarrhea-predominant (IBS-D), constipation-predominant (IBS-C) and mixed or alternating disorder (IBS-M). About 35 percent of patients suffer from IBS-C, and IBS accounts for 12 percent of adult visits to primary care physicians in the U.S.
